These Terms may be updated from time to time. We will notify you of any material changes at least 30 days before they take effect by email or by posting a notice on our website. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.

1. Account Registration

To use most features of the Services, you must register for an account. You can register using your Google account through our Google OAuth integration. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring you are at least 18 years of age or have legal parental or guardian consent

2. Subscription Plans and Payment

Vilsee offers various subscription plans, including a free trial and paid subscription options. For paid subscriptions:

• Payment will be charged to your specified payment method at the beginning of each subscription period
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• You authorize us to charge your payment method for the subscription plan you select
• Price changes will be notified 30 days in advance and will not apply retroactively to previous billing periods
• You may request a refund within 14 days of the beginning of your initial subscription period if you are not satisfied with our Services

3. Use of the Services

3.1 Usage Restrictions

You agree not to:

• Use the Services in any way that violates any applicable law or regulation
• Use the Services to transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable
• Attempt to reverse engineer, decompile, or disassemble any portion of the Services
• Attempt to gain unauthorized access to any portion of the Services or any related systems or networks
• Use any automated means, including bots, scrapers, or spiders, to access or use the Services
• Interfere with or disrupt the Services or servers or networks connected to the Services
• Sell, license, rent, or otherwise commercially exploit the Services or make the Services available to any third party

3.2 Content Guidelines

When using our Services to process, analyze, or visualize content, you agree not to upload, submit, or process content that:

• Infringes on the intellectual property rights of others
• Contains malware, viruses, or other malicious code
• Violates any person's privacy rights
• Promotes illegal activities or contains illegal content

We reserve the right to remove any content that violates these guidelines.

3.3 Usage Limits

Your use of the Services may be subject to usage limits based on your subscription plan, including limits on the number of visualizations you can create, the size of files you can upload, and the frequency of API requests. Current usage limits are clearly specified in your subscription plan details.

4. Intellectual Property

4.1 Ownership of the Services

The Services, including all software, designs, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and code that appear on or form part of the Services, are owned by Vilsee or our licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

4.2 Your Content

You retain all rights to the content you upload, submit, or process through our Services. By using our Services, you grant us a non-exclusive, royalty-free license to use, reproduce, modify, adapt, and display your content solely for the purpose of:

• Providing the Services you have requested
• Improving our Services and algorithms
• Maintaining and administering our systems
• Enforcing our Terms
• Complying with applicable laws

This license is limited to the duration of your use of our Services and for a reasonable period thereafter for backup and record-keeping purposes.

5. Data and Privacy

Our Privacy Policy explains how we collect, use, and protect your information when you use our Services. By using our Services, you agree to our collection, use, and sharing of information as described in the Privacy Policy.

When you upload content for processing or visualization:

• We analyze and process this content using our AI and visualization technologies
• We implement industry-standard security measures to protect your content from unauthorized access or disclosure
• We store your content and the resulting visualizations on secure servers with encryption in transit and at rest
• We retain your content for the duration of your account plus 30 days after account termination

6. Warranties and Disclaimers

Vilsee warrants that:

• The Services will perform substantially in accordance with our published specifications
• We will use commercially reasonable efforts to make the Services available 24/7, except for planned maintenance
• We will implement and maintain appropriate technical and organizational measures to protect your content

EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH ABOVE, THE SERVICES ARE PROVIDED "AS IS" AND VILSEE HEREBY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

VILSEE DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED, THAT ALL DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VILSEE BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF VILSEE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL VILSEE'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE GREATER OF:

• THE AMOUNT PAID BY YOU TO VILSEE FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR
• ONE THOUSAND DOLLARS ($1,000)

8. Term and Termination

These Terms shall remain in full force and effect while you use the Services or maintain an account with us.

You may terminate your account at any time by following the instructions on our website or by contacting our support team.

We may suspend or terminate your account and access to the Services under the following circumstances:

• With Notice: We will provide at least 14 days' notice before terminating your account for:
  • Non-payment of fees after multiple reminders
  • Inactivity exceeding 12 consecutive months (for free accounts)
  • Repeated minor violations of these Terms
• Immediate Termination: We may terminate your account immediately for:
  • Material or repeated violations of these Terms
  • Engagement in illegal activities
  • Upon request by law enforcement or other government agencies
  • Critical security threats to our Services or other users

Upon termination of your account:

• Your right to use the Services will cease
• You will have an opportunity to export your content and data within 30 days after termination
• After the 30-day period, we may delete your account information and content
